Why you MUST make a Will
1- Your loved ones ie your husband/wife/children/mother/father may get nothing and may have no one to look after them.
2- Your business/property/money in bank/shares/car may go to someone else
3- The Inland Revenue (The Tax Man) may take a large portion.
The UK has an inheritance system that does not comply with the Shariah/Islamic rules. By making a Shariah Will therefore you can ensure that your family get what the Shariah & Islam has ordained for them.
However Shariah has an inheritance system that is pre-fixed and automatically gives your estate to your family members. Some Muslims may not wish to give away their estate according to the Shariah rules and this can cause a religious/moral dilemma. We can therefore attempt to ensure that your property and assets are distributed according to your wishes BUT that it does NOT breach the Shariah Rules. According to the Holy Quran:
Surah An NisaVerse 13. These are the limits (set by) Allah (or ordainments as regards laws of inheritance), and whosoever obeys Allah and His Messenger (Muhammad, Peace Be Upon Him) will be admitted to (Paradise), to abide therein, and that will be the great success.
According to the Sunnah of the Holy Prophet Muhammad (PBUH):"It is not permissible for any Muslim who has something to bequeath (to give away upon death) to stay two nights without having his Last Will & Testament written and kept ready with him" Sahih Bukhari Book of Wills Volume 4, Book 51, Number 1.
